This applies to you if …
- You offer B2C services in electronic commerce (online shop, booking, app).
- You distribute in-scope products such as e-book readers, self-service terminals or consumer devices.
- For SERVICES, you are not a micro-enterprise under the exemption (fewer than 10 staff AND annual turnover or annual balance-sheet total of at most EUR 2 million). Note: this exemption applies to services only — placing in-scope products on the market is not exempt even for a micro-enterprise.
Core obligations
- Make websites, apps and digital purchase flows accessible (aligned with WCAG / EN 301 549).
- Provide an accessibility statement listing the requirements met.
- Ensure digital offerings are perceivable, operable, understandable and robust.
- Provide a feedback and complaints channel for accessibility barriers.

First steps
- Check whether your digital B2C offerings are in scope and whether the micro-enterprise exemption applies.
- Run a WCAG 2.1 AA quick check on your key user flows.
- Fix critical barriers first (contrast, keyboard operation, alt text, forms).
- Create and publish an accessibility statement.

Penalty for non-compliance
Market surveillance by the competent federal-state market surveillance body; orders and distribution/provision bans possible. Fines under Section 37 BFSG: up to EUR 100,000 for serious breaches, otherwise up to EUR 10,000.
